Income of husband, not sole criterion to award Maintenance!

 

The High Court of Delhi in a case between Deepak Malhotra and Deepti Malhotra and Ors ordered recently that there is no strict mathematical formula to calculate the maintenance amount to wife. It must be calculated according to the surrounding circumstances and must be fair to both the parties.

 

Justice Ashok Kumar pointed that while determining the maintenance amount not only the income of husband but also the liabilities of husband, the financial status of both parties are to be considered.

 

The HC after taking into consideration the monthly income of the husband, the interim maintenance amount is reduced to Rs. 20,000 per month to the wife.
