About/from the judgment:

It is true that when such a question arises for consideration by the Court, no judgment can be cited as a precedent howsoever similar the facts may be. As was observed by this Court in Pandurang and others vs. State of Haryana : AIR 1955 SC 216 each case must rest on its own facts and the mere similarity of the facts in one case cannot be used to determine a conclusion of fact in another.
